1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of SabiMaketa, operated by Padifi LLC ("Company", "we", "our"). By creating an account or using our platform, you agree to be bound by these Terms. If you do not agree, do not use the platform.

2. Description of Service

SabiMaketa is an autonomous marketing platform that creates, schedules, and publishes content across digital platforms on your behalf using intelligent automation. The platform is operated through our website at sabimaketa.com and any associated applications.

3. Eligibility

You must be at least 16 years old and capable of forming a binding contract to use SabiMaketa. By using our platform, you represent that you meet these requirements. If you are using the platform on behalf of a business, you represent that you have authority to bind that business to these Terms.

4. Your Account

• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately of any unauthorised access at [email protected].
• You are responsible for all activity that occurs under your account.
• One person or legal entity may not maintain more than one free account.

5. Your Content

You retain all rights to content you create or approve through SabiMaketa. By using our platform to publish content, you grant us a limited licence to transmit that content to connected platforms on your instruction.

You are solely responsible for content published through your account. You represent that:

• You own or have the right to use all content published through your account
• Your content does not violate any applicable laws or third-party rights
• Your content complies with the terms of each connected platform

6. Acceptable Use

You agree not to use SabiMaketa to:

• Publish spam, misleading content, or coordinated inauthentic behaviour
• Violate any applicable laws, regulations, or platform terms of service
• Infringe intellectual property rights of others
• Publish content that is defamatory, obscene, or harmful
• Attempt to reverse-engineer, hack, or disrupt our systems
• Use the platform for any unlawful purpose
• Impersonate any person or entity
• Publish content promoting violence, discrimination, or hate

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

7. Connected Platform Accounts

When you connect social media or publishing accounts, you authorise SabiMaketa to act on your behalf within those platforms. You remain responsible for compliance with each platform's terms of service. We are not liable for actions taken by connected platforms including account suspension or content removal.

8. Subscription and Payment

Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except where required by law or as stated in our refund policy. We reserve the right to change pricing with 30 days' notice. Failure to pay will result in suspension of paid features.

9. Intellectual Property

The SabiMaketa platform, including its design, code, and underlying systems, is owned by Padifi LLC and protected by intellectual property laws. You may not copy, modify, or distribute any part of our platform without written permission. Our name, logo, and trademarks may not be used without permission.

10. Disclaimer of Warranties

SabiMaketa is provided "as is" without warranties of any kind. We do not guarantee that the platform will be error-free, uninterrupted, or that content generated will achieve specific marketing outcomes. You use the platform at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, Padifi LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of SabiMaketa. Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Termination

You may delete your account at any time from the Settings page. We may suspend or terminate your account for violation of these Terms, with or without notice depending on the severity. Upon termination, your right to use the platform ceases immediately. Sections that by their nature should survive termination will do so.

13. Changes to Terms

We may update these Terms at any time. We will provide at least 14 days notice for material changes via email and an in-platform notice. Continued use after the effective date constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of Nigeria. Disputes shall be resolved by arbitration in Lagos, Nigeria, except that either party may seek injunctive relief in any court of competent jurisdiction.
